TERM OF SUBLEASE

Beginning:                        ___________________________, 20____

The parties agree as follows:

 

Use of Premises:  The premises are to be occupied solely for the residence of the Undertenant.  No dogs are to be maintained on the premises.

Rent:  The rent of $_____________ monthly shall be paid by the Undertenant directly to the Landlord (Queensview) in advance on the first day of each month during the Term.

Security:  The security for the Undertenant’s performance is $3,000 and is to be held by the Landlord.  The security shall be subject to forfeit in the event that a) the apartment is not vacated at the end of the Term, or b) there is a failure to pay rent, or c) the Undertenant damages the Landlord’s property, or d) the Landlord incurs legal expenses in the enforcement of the agreement.

Agreement to Lease & Pay Rent:  Overtenant sublets to the Undertenant for the Term.  The Undertenant agrees to pay the rent and other charges as required in this Sublease.  The Undertenant agrees to do everything required of him in this Sublease.  The Overtenant agrees to pay any increase reflected on the monthly rent statement that is made during the term of the sublease agreement.

Joint Obligations:  The Overtenant and the Undertenant each agree to be bound by the obligations of the other hereunder and are jointly and severally liable to the Landlord for all payments due it hereunder.

Notices:  Notice to the Undertenant shall be considered properly given in writing and either delivered to the apartment or mailed by certified mail, addressed to the Undertenant.

Subject to:  This sublease is subject to the Overlease.  It is also subject to any agreement to which the Overlease is subject.  The “Overlease” is the standard form into which the Landlord, a cooperative housing development, enters with its tenants, including the Overtenant.  The Undertenant states that he will not violate the Overlease in any way.

Overtenant’s Duties:  The Overlease describes the Landlord’s duties.  The Overtenant is not obligated to perform the Landlord’s duties.

Jury Waiver:  The parties give up the right to trail by jury in any claim related to this sublease.

Cost of Reconditioning Premises:  This sublease shall not relieve the Overtenant of his obligations under the terms of the Overlease including, without limitation, the Overtenatn’s responsibility for reconditioning the apartment upon termination of the Overlease.

No Authority:  All parties acknowledge and agree that the rental fixed in this agreement is the maximum rental which the Landlord will permit for this apartment and shall include the use of all other personal property (furniture, appliances, etc.) which are located in the apartment.

Successors:  In the event of the death or the incompetentcy of the Overtenant before the expiration of the Sublease, the Sublease Agreement shall be considered terminated and the Landlord and the successor or duly approved representative of the Overtenant shall be released of any obligation under the sublease.  However, the agreement may continue if both the Landlord and the duly approved representative of the Overtenant give their consent in writing.

Consent:  The consent by the Landlord to this Sublease is granted for the term of the Sublease only.  Any consent granted hereby should not be construed to be the consent of any future subletting or assignment either to this Undertenant or to any other proposed Undertenants.  The consent of the Landlord is given pursuant and subject to the terms of Queensview’s policy on subleasing.

No Waiver:  If the Landlord has failed on one or more previous occasions to exercise any option, right or power contained in this Sublease, it shall not be treated as a waiver of the Landlord’s right to take action against the Overtenant or the Undertenant for any current or future violation of any kind.

Entire Agreement:  This Sublease contains the entire agreement and may be changed only by an agreement in writing signed by the parties to the Sublease.

Pronouns and Plurals:  All pronouns and any variations thereof shall be deemed to refer to the masculine, feminine, neuter, singular or plural as to the identity of the person, persons, or entities to which applicable may refer.
